Felling Trees and Tree Preservation Orders (TPO)
Trees are usually felled for either safety reasons, for example, where a tree is decaying or dead and becomes a safety hazard, or to facilitate property or infastructural development such as housing, new transport links or clear overgrown gardens. If the tree is in a conservation area or is subject to a tree preservation order (TPO) which is an order made by a local planning authority in respect of trees or woodlands and can be on any tree.
Trees in conservation areas may be the subject of a TPO and subject to the normal TPO controls. But the Town and Country Planning Act 1990 does make special provision for trees in conservation areas which are not the subject of a TPO.
If you are planning on carrying out any work on a tree in a conservation area you need to give 6 weeks’ notice this gives the authorities an opportunity to consider whether a TPO should be made in respect of the tree.
